Terms of Sale

These terms of sale apply to purchases of goods from Montez in the online store. Together with your order, they form the agreement between you as a consumer and Montez.

Unless otherwise agreed, the Norwegian Consumer Purchases Act, the Right of Withdrawal Act, the E-commerce Act and the Personal Data Act apply.

The parties

Price and payment

All prices are stated in Norwegian kroner (NOK) and include value-added tax (VAT). Shipping is included, so the price you see is the total price – with no hidden fees.

The agreement is binding once your order has been registered with Montez, and you receive an order confirmation by email.

Payment is processed securely through Shopify Payments.

Delivery

Delivery time: 3–5 weeks from order.

The rings are made or resized after you place your order. The expected delivery time is stated on the product page and in the order confirmation.

Shipping is included in the price and is sent throughout Norway.

The risk for the item passes to you when you, or someone you have designated, have taken possession of the item. If delivery is significantly delayed, you may withhold payment, demand performance, terminate the agreement or claim compensation under the Consumer Purchases Act.

For returns, you must contact Montez first to obtain a return address. Never send a ring back without prior agreement.

Right of withdrawal and exchange

You have a 14-day right of withdrawal when you shop in the online store, under the Norwegian Right of Withdrawal Act. The period runs from the day you, or someone you have designated, take physical possession of the ring.

To exercise the right of withdrawal, you must notify Montez within the deadline. You may use the standardised withdrawal form that accompanies your order confirmation, or notify us in another clear manner at Contact@montezdiamonds.no. We will confirm receipt.

The right of withdrawal is lost for rings that are engraved or otherwise given a clear personal character, cf. Section 22(e) of the Right of Withdrawal Act. This is clearly stated before purchase, and you confirm the choice when you order engraving.

The ring must be returned within 14 days after you gave notice. It must be unused and in the same condition as on delivery, and the certificate must be included. You cover the direct cost of return. Contact Montez first to obtain a return address – never send a ring back without prior agreement.

Montez will refund all payments received without undue delay and no later than 14 days after we received notice that you are exercising the right of withdrawal. We may withhold the refund until the ring has been received, or until you have documented that it has been sent.

Exchange (voluntary arrangement by Montez): As long as the ring is not engraved, Montez also offers to exchange it for another ring, even after the withdrawal period has expired. This is a voluntary, customer-friendly arrangement that comes in addition to your statutory rights.

Warranty, complaints and certificate

Right of complaint: 5 years. Certificate: IGI (lab-grown) / GIA (natural).

If the item has a defect, you may, under the Consumer Purchases Act, demand rectification, replacement, a price reduction, cancellation or compensation. Any complaint (reklamasjon) must be made within a reasonable time after you discovered or should have discovered the defect.

A certificate accompanies every ring, and the certificate is considered part of the item's description.

Montez provides no warranty beyond the statutory right to complain (reklamasjonsrett).

Dispute resolution

If you fail to pay or otherwise do not fulfil the agreement, Montez may withhold the item and assert its rights under the Consumer Purchases Act.

If you have a complaint, we encourage you to contact us first so we can find a solution. You may also complain to the Norwegian Consumer Authority (Forbrukertilsynet) or the Consumer Council of Norway (Forbrukerrådet). For cross-border purchases within the EU/EEA, disputes may be submitted to the European Commission's online dispute resolution portal (ODR).
